Perhaps the most frustrating part of the litigation process, enforcement is needed where the Court authorises a settlement or gives judgment in your favour but you can’t get teh defendants to pay up! There are well established methods, both in the UK and abroad to make sure that the defendants can be forced to pay, but it is essential that the legal team is able to identify assets to enforce the judgement against. This should always be investigated before the case is started in the first place. If you have a judgment against a defendant that really can’t pay, you have wasted your time suing them.
